Fred Whittington Is Granted Divorce
_______

Wife Denied Alimony But Gets Temporary Custody Of Their Daughter
_______

A decree granting Fred L. Whittington, Burlington fireman, a divorce from his wife, Nora B. Whittington was signed Monday by District Judge Broady. Mrs. Whittington’s cross-petition asking that she be granted the divorce was dismissed and she was ordered to pay all costs of the suit.

Judge Broady’s decree stated that Mrs. Whittington had shown “gross”, wanton and extreme cruelty toward Mr. Whittington to such an extent as to utterly defeat the legitimate objects of matrimony.”

Temporary custody of their 15-year old daughter, Bessie May, was granted Mrs. Whittington. Mr. Whittington is a “fit and proper person to have custody of the child” but the child has indicated she wishes to remain with her mother for the present, the decree stated. Mr. Whittington will pay $50 monthly for the child’s support and he is given the right to see her at all reasonable times. Mrs. Whittington is ordered not to take the child out of the county pending a future court order determining the child’s permanent custody and support.

The decree stated that that Mrs. Whittington is not entitled to any allowance for alimony. She is ordered to pay her attorney, R. O. Johnson, a fee of $200.

During recent trial of the divorce suit Mr. Whittington testified that Algernon O. Johnson, Burlington engineer with whom he had a fight in the cab of a speeding train last summer, was the chief factor leading to the divorce. The Burlington announced Johnson’s retirement Monday morning.

Mr. and Mrs. Whittington were married Sept. 17, 1916 in Morrowville, Kas.
