3601. “TESTIFY GIRL WAS LAME,” Relatives, Friends, Doctors Swear Maxine George Wasn’t Shamming Lameness, Lincoln Evening Journal, LIncoln, NE, February 25, 1928, 7.
A second batch of affidavits in the camage suit of Maxine George against the Missouri Pacific was filed late Friday by the plaintiff, her mother, stepfather, grandparents, uncle, and several doctors and a number of friends in Kansas City. They are in answer to others filed by the railroad last week in support of its mothion for a new trial, on the ground that Maxine was a citizen of Nebraska last fall, wasn’t lame, and was married to Sam Houser and therefore capable of bringing suit in her own person rather than by her fater, C. E. George. A jury awarded her $7,535 because of an injury suffered in falling from the icy platform of a car.

Sam Houser testifies that he isn’t married to Maxine and couldn’t be, because he was married April 9, 1923, to Edna A. Brookfield at Lincoln, and still is her husband. He attaches a certificate, showing them to have been married by Judge Reid. He denies that he is engaged to Maxine George or to anyone.

Edward A Stephens and Mrs. Mary Stephens, grandparents of Maxine, say she was born in their house, went to school in Lincoln all her life, and went to Kansas City to stay with her mother last June when their house burned. The girl’s mother, Bertha Bergin, and her stepfather, Richard F. Bergin, of Fairmont, Mo., tell the same story, and say Maxine went to room in Kansas City because their house was too crowded. Maxine makes a similar affidavit, denying an alleged conversation with Glen Huffman on the subject of her lameness. A number of Kansas City people testify to her lameness, as do Doctors J. D. Case, C. H. Arnold, Rea Buchanan, Charles A. Blanchard and W. G. Rickard, all of whom have examined her since the trial.

Mrs. Nettie Stephens, aunt by marriage of Maxine George, field an affidavidt Saturday in federal courtn, in Maxine’s damage suit against the Missouri Pacific. The railroad company is seeking a new trial for the case, in which a jury awarded Maxine damages in November, on the ground that her injuries weren’t as serious as she said. Mrs. Stephens, the wife of Harley Stephens, swears she knew all the time the girl was faking, but couldn’t tell it before because of her relation to the family. Now there is a divorce suit pending between her and Harley Stephens. She says the girl’s real name is Iris Mildred George, and that she claimed to have been married to Sam Houser a year ago, but the affiant doesn’t believe it.

Charels McElfresh Smith of Route 1, Adamstown, died Sunday in Frederick Memorial Hospital, where he had been a patient for a week.

He was born near Hyattstown on March 17, 1897, a Son of the late Charles Henry and Rachel Eleanor McElfresh Smith. Surving is his wife, Mrs. Kathryn Turner Smith of Yellow Springs, two sons, Charles M. Smith Jr., of Yellow Springs and William A. Turner Smith of Baltimore; eight grandchildren and a great grandson.

Mr. Smith was a veteran of World War I. He was employed by the State Roads Commision as a Highway Engineer.

Friends my call at the funeral home, at 106 East Church St., today from 4 to 9 p.m. Services will take place Wednesday at 2:30 p.m. from the funeral home.

The Rev. H. Austin Cooper, pastor of Bush Creek Church of the Brethren, will officiate. Interment will be in the Mount Olivet cemetery.

Ruby L. Thomas, 57, born April 13, 1957, in Olney, Md., passed away Wednesday, August 20th at Frederick Memorial Hospital.

She was the daughter of the late Mattie L. Mayhew and William F. Mayhew.

Survived by son Richard Mayhew and wife Jennifer Mayhew; daughter Kristy Reid and husband Greg Reid; son James Kipe and his friend Rachel Sizemore; son Robert L. Thomas; daughter Robin Ertel; and son Brandon Ertel; six grandchildren; her siblings sisters Francis Gaver, Virginia Gaver and Donna Ledford.

She is preceded in death by sister Carolyn Mayhew. Surviving brothers are William Mayhew, Robert Mayhew and Rodney Mayhew.

Survived by numerous neices, nephews and cousins.

Memorial services will be held Aug. 30th at Centennial Church (second chance hope) on Second Street, Frederick, Maryland, at 2:00 to 6:00.

Mr. Ralph Eugene Gaver Sr., 60, of Frederick, died Friday, Feb. 5, 2010, at his home.

He was born Nov. 30, 1949, in Olney, to the late John Harold Sr. and Nellie Catherine Crilly Gaver.

He was employed with Schildt Construction of Thurmont, and previously employed by Bollinger Construction of Emmitsburg.

He attended Faith Baptist Church, Knoxville.

Survivors include his wife, Virginia Ann Mayhew Gaver of Frederick, married for 40 years; son, William Kenneth Mayhew and wife, Michele, of Hagerstown; son, Ralph Eugene Gaver Jr. and wife, Suzanne, of Brunswick; sister, Ara M. DeVinney and husband, Grant, of Suitland; sister, Mary C. Whipp and husband, Pete, of Emmitsburg; brother, John H. Gaver Jr., of Emmitsburg; brother, Richard E. Gaver and wife, Barbara, of Emmitsburg; grandchildren, Tiffany, Tyler and Marissa Mayhew and Scott and Dylan Gaver; and great-grandchildren, Emir and Zaniah Barnes.

He was loved by everyone who knew him and will be greatly missed, especially by one niece, Connie (Redneck) Stouter of Fairfield, Pa., as Uncle Ralph became her "Hero."

He was predeceased by three sisters, Alice Lawrence, Nancy Irwin and Bonnie Dubel.

The family will receive friends from 7 to 9 p.m. Thursday, Feb. 11, at Osborne Funeral Home, 425 S. Conococheague St., Williamsport. The funeral home will be open after 9 a.m. Thursday for the convenience of family and friends.
