4601. “The Custody of the Children Is Given to the Mother With Privileges to the Father,” August Laue and Henrietta Simmermacher, The Pacific Bee, Sacramento, CA, January 10, 1894, 7.
Judge Johnson this morning granted August Laue a divorce from his wife on the ground of desertion. The custody of the two minor children was awarded to the mother and the divorced husband was ordered to contribute $25 monthly to the care of the children.

Mrs. Laue was in Court with her attorney, C. N. Post, and did not oppose the divorce. The custody of the children, two bright little girls aged respectively 15 and 12 years, was the bone of contention.

Pending the divorce suit Judge Catlin denied the application of Laue that he have the children. It was ordered however that he be allowed at all reasonable times to visit the girls.

To Judge Johnson this morning Laue, who was represented by General A. L. Hart, complained that the children did not have the affection for him he thought they should have, and that the mother had poisoned their minds against him. Laue said he had stopped visiting the girls at their mother’s house because he believed he was not welcomed.

A. G. Johnson of Anderson & Johnson, the employers of Laue, testified that he was an industrious and sober man. At Laue’s request the witness had called on Mrs. Laue to patch up peace, but she refused to consent to any proposition that would result in bringing them together again.

General Hart introduced in evidence copies of letters Laue had written his wife pleading that she return to him. Judge Post called to the stand Mrs. Simmermacher, the mother of Mrs. Laue. She testified that her daughter and the children lived with her. Laue was never refused permission to see his children. She had often told them to respect their father. The girls were given the best of care and treatment. They were sent to school daily and also attended Sunday-school.

Mrs. Laue testified that she had no objection to the children being visited or called on by the father. She never poisoned the girls’ minds against their father, but she has told them to respect their father.

Judge Johnson questioned the little girls. They said that they were prepared to live with their mother. They had no ill-will against their father. He had given them presents and treated them nicely. One of the girls said that the father had said things to her against the mother, however.

Judge Johnson said that he thought Laue was over-sensitive over the deep affection he had for his children. This was a case of incompatibility of temper. The feelings of Mr.and Mrs. Laue were not to be considered in the matter of the children's future welfare.

Laue could not give the girls the same care and attention as the mother and grandmother have been doing and can do, and in view of that fact the Judge awarded the custody of the children to the mother with the provision that the father should not be hindered in any manner whatsoever from visiting them or taking them out at reasonable times. The Judge further ordered that the girls should not be allowed to leave the county except after an order of Court.
