Cruelty of the most extreme character is charged in the divorce petition of Amanda Hagel vs. John C. Hagel, filed yesterday in district court. The parties were married in this city in December, 1908, and there is a son one year old. Plaintiff charges that on numerous occasions defendant has beaten her with his fists until she was unable to stand and that when she threatened to have him arrested he told her that if she did did he would kill her as soon as he got out of jail. She declares that on August 1 he gave her a terrible beating, whereupon she left him, taking her baby with her. Then, she says, he took a sledge hammer and broke up all of the furniture, most of which had been given her by her parents. Lack of proper support is also charged and plaintiff avers that she has been compelled to depend upon her own labor and the charity of her parents for a good part of her living. She wants the custody of the child and temporary and permanent alimony, and asks that defendant be restrained from interfering with her.

J. H. McNeeley, father of Mrs. Vera Hagel, has taken exception to the printed report in The Star last Saturday, saying that her husband, who is a convict at the penitentiary, was permitted to attend the funeral. Mr. McNeely says that Hagel has never been allowed to speak to a member of the family for the last year and had he been permitted to leave the prison in company with a guard, he would not have been permitted to come near the home when the funeral was held. Investigation at the penitentiary shows that Hagel did not attend the funeral. The error arose through a mistake of one of the attaches at the prison. Information was given a Star reporter by him that the man would be permitted to attend the funerul which is in error.

Havel Used Force to Get Father—in-Law's Consent.

Tom Hagel was fined $5 and costs yesterday afternoon by Police Judge Risser for assaulting J. H. McNeeley on July 14. The trial of the case has been delayed because Hagel jumped the $100 bond that his father signed for his appearance.

Mr and Mrs. McNeeley testified that Hagel had come to the house with a club In his hand, making threats of what he would do if they did not allow him to see their daughter. Hagel had wed the girl earlier in the day, but as she was under sixteen years of age, the parents refused to allow her to leave their home.

McNeeley stated that when he came out of the house and told Hagel that he could not take the girl away, Hagel hit him with a heavy stick. McNeeley said that the blow knocked him down but that he managed to defend himself from other blows and he thought that he rather got the better of the encounter. The witness declared that after the fight Hagel went across the street, picked up a piece of cement, and asserted that he would kill the "whole damn family." Hagel acted as his own attorney and cross-examined his father-in-law.

Hagel married the McNeeley girl against the wishes of her parents. At he time of the wedding she was alleged to be but fifteen years old. Mr and Mrs. McNeeley stated that they were opposed to Hagel as a husband for their girl and even If they were not, she was yet but a child and was too young for marriage.

Judge Risser told Hagel that If he wanted to regain possession of his wife he should take lawful means to accomplish his desire and not try to take her from her home by threats. The young man said that he did not care to ask his wife to live with him now. Under the statutes a marriage where one of the contracting parties is under the legal age is void, if the proper steps are taken to have It annulled. The defendant paid the fine and costs which amounted to $12.75.

HEEGEL CLAIMS HE WAS AT HOME

Defendant in Assault Case Contradicts Everybody Who Says He Was Down Town. John Conrad Heegel, charged with statutory assault upon fourteen year old Lucy Blood on May 3, testified in his own behalf in district court Tuesday morning and denied positively that he had had anything to do with the girl or that he had ever seen her until the preliminary hearing in justice court. He testified that he slept at home the night he is alleged to have spent with the girl at the Rex hotel and his father, John Heegel, corroborated the latter statement.

Heegel denied categorically every detail of the story told by the prosecuting witness as well as the testimony given by the witnesses Walling and McCoy, who had sworn that they saw him with the Blood girl. He stated that he was at his home during the afternoon, coming up town at 5 o'clock. After he had done his work he was with McCoy until 10:30 o'clock, when he went home and stayed all night. His father and mother were there, and the latter got breakfast for him when he got up at 5:30 in the morning.

Before closing their case the attorneys for the state called Belle McClory, who was doing chamber work at the hotel on the night the defendant is alleged to have been there with the prosecuting witness, and she identified the register, which bore the entry "T. J. Hagel and wife, Omaha," and indicated that they had been assigned to room 29. The witness testified that the man who had room 29 had met her in the hall and told her that he was going out to get his wife.

The defendant denied that he had been at the hotel that night or that the signature on the register was his. W. W. Walling, ticket taker at the Wonderland theater where Heegel was employed, identified a bill of sale for a typewriter which had been given him by the defendant, whom he saw sign the same. It was signed "T. J. Hagel" and the signature was identical with that on the hotel register. Heegle swore that "Walling not only wrote out the bill of sale but that he signed the name of defendant to it by authority of Heegel. Walling also testified to having seen the Blood girl in front of the theater and to having seen Heegel with her afterwards.

On cross examination the defendant admitted that he is a married man and stated also that he did not ask the sheriff why he was arrested and did not know why until the warrant was read to him after he was in the county jail. He said that ever since he had been in this country he had spelled his name "Heegel." but Robin R. Reid, clerk of the county court, was called by the state to prove that this was not the truth. Reid produced the marriage records, which showed that in 1908 John Conrad Hagel had obtained a license to wed and that in June, 1911, Conrad John Hagel had procured a similar permit. The first wife obtained a divorce and the defendant is not living with the second. The signature to both applications for license is in the same handwriting as that which appears on the bill of sale to Walling and on the register of the Rex hotel.

John Hagel was granted a decree of divorce from Elizabeth Hagel by Judge Flansburg of the district court Wednesday morning. They were married in Lincoln on August 8, 1916, and he testified that she had treated him with extreme cruelty, nagging him and calling him vile names, in addition to wrongfully accusing him of infidelity. She also complained constantly of the meagerness of his income.

John Hagel, ex-meter reader of the city, pleaded guilty to a minor charge when arraigned before Justice of Peace W. A. Hawes Tuesday. He was sentenced to ninety days in the county Jail. It Is alleged that Hagel committed the unlawful act last Saturday. A resident of south Lincoln made a complaint to the police that Hagel had attempted to attack his ten-year-old daughter In the yard of heiihome. County Attorney Matson said that Hagel had agreed to leave the United States immediately following the expiration of his ninety day sentence. It Is expected that Mr. Hagel will Journey to South America, it was said.

Raymond Dale Hooper, age 86, of Ink, Arkansas died Thursday, July 18, 2013 at the Rich Mountain Nursing and Rehab. He was born on Thursday, September 16, 1926 to Willie Wayne and Eliza Lott Hooper in Mena, Arkansas.

Raymond was a true man of God and served his Lord with all his heart. He served in the Gideon Ministry for 56 years. Raymond was a member of the Anointed Faith Tabernacle in Mena. He served his country in the United States Navy during World War II. He worked as a butcher for 20 years at the Swifting Company in Fort Smith. Raymond also was a Ham Radio Operator and enjoying meeting people from all over the world. He has talked to people from over 310 foreign countries over the years. He served as a volunteer fireman for the Ink Fire Department for many years. Raymond was a loving, father, grandfather, brother, uncle and friend, and will be missed by all who knew him.

Raymond is preceded in death by his parents, his wife, June Hooper; one son, Stephen Hooper; one brother, James Hooper; and one infant sister.

Raymond is survived by his son and daughter in law, Paul and Barbara Hooper of Mena; three brothers, Willard Hooper of Mena, Harold Hooper of Benton and Kenneth Hooper of Mena; three grandchildren, Emilee Langford of Owensboro, Kentucky, Zachary Hooper of Fort Smith and Jordan Hooper of Mena; several nieces and nephews, and a host of other relatives and friends.

Funeral services will be Saturday, July 20, 2013 at 10:00 A.M. at the Bowser Family Funeral Home with Brother Wally Beckman officiating. Interment will follow in the Concord Cemetery. Visitation will be Friday, July 19, 2013 from 6-8 P.M. at the Bowser Family Funeral Home in Mena.

Pallbearers will be Audrey Cost, Burt West, Bob Pack, Shannon Langford, Zach Hooper and Jordan Hooper.

Mr. Debus brought the divorce action but did not appear at the trial and the case was tried on Mrs. Debus cross-petition. The parties were married November 18, 1919. Mrs. Debus charged her husband with cruelty and non support.

Kansas Girle Angles With Lincoln Boy Who Has No Legal Right to Fish and Who Has Stolen Car

Pretty Anna Fencil of Morrowville, Kas., discovered much to her sorrow that Conrad DeBus of Lincoln is a poor fisherman. He took her out to snare a mess of fish without telling her that he had neglected to arm himself with a fishing license. Nor did he confide in her that the 1920 Velie car in which they went fishing was stolen by him in Lincoln on April 18.

Conrad wanted Anna to think nice things of him. He did not tell her that the pressing creditors forced him of steal. That’s what he later told the officers. DeBus was arrested while fishing near Morrowville.

DeBus was brought to Lincoln by a representative of the state sheriff’s office Special Officer Schneible. Miss Fencil volunteered to join the party and gave such assistance as possible. She carried out her promise and
to return to her home.

According to his own admission, Conrad not only traveled about in a stolen car but passed a bad check for $26.80 in Grand Island. His creditors, he says, forced him to steal and the force the bad check. How could he know that the casings would blow out or that he would lose the gas tank.

Young Man, Recently Divorced, Admits Stealing Car Belonging to Lincoln Man

Conrad Debus, twenty-one years old, was sentenced to serve from one to ten years in the state reformatory Tuesday afternoon after he had pleaded guilty to a charge of stealing the auto of Chris Economedes, April 18, 1922. Young Debus was divorced recently from Rachel Debus, who testified that her husband had apparently lost affection for her, and testified that he had told her he did not want to live longer with her. Debus first filed for divorce but the wife won on a cross petition when the plaintiff did not appear for trial.

Debus took the auto he stole to Kansas and was arrested there in company with a young woman while on a fishing trip. He said he had been thrown out of employment, and that a tailor had threatened to take away a new suit of clothes unless a payment was made. In the face of this, he said, there was nothing to do but skip the country.

Mrs. Laura Berry, 68, former Lincoln resident, died in Boise, Ida., Friday night, according to word received here Saturday by her twin sister, Mrs. Clara Frey, 1417 O Street. Mrs. Berry had been in ill health for several months. She is survived by her husband, Dorvan Berry, two sons, Glenn and Sheral, all in Boise, and another sister Mrs. Alice Tanner of Bethany.

Mrs. Berry lived in Lincoln for a number of years while her husband was engaged in business here. She was a former member of the Grace Methodist Church.
